Terms of Service
1. Agreement and operator
These terms govern your use of the Kiki eSIM app and related services operated by (“Spicy Kiwi”, “Kiki”, “we” or “us”). By creating an account, using the service or completing a purchase, you agree to these terms and any plan details shown before payment. If you do not agree, do not use or purchase through the service.
2. Accounts and crew verification
You must give accurate information, protect access to your device/account, and tell us about suspected misuse. Crew benefits may require verification through an eligible work email and may expire or be withdrawn if the verification is no longer valid. Test or preview controls do not create an entitlement to a paid benefit.
3. eSIM plans and compatibility
An eSIM plan is a digital connectivity service consumed outside the app. Availability, allowance, validity, supported countries/networks, fair-use conditions and price are the facts shown for the selected sellable package at checkout. Do not rely on an unavailable or preview package. Your device must be unlocked, eSIM-compatible and configured correctly; local network coverage and speed can vary.
Zetexa and participating mobile networks provide the underlying connectivity. They may apply fair-use, network-management and coverage limitations. Kiki does not promise uninterrupted service, a particular speed, or coverage where the supplier does not offer a sellable package.
4. Orders, payment and activation
The final amount and package are shown before payment. Apple Pay/card payments are processed by Stripe; payment credentials are handled by the relevant payment platform. A payment confirmation does not by itself prove that an eSIM has been installed or activated. Follow the install status in the app and contact support when the approved support channel is available if provisioning fails.
Plan validity and data consumption depend on the package terms and supplier activation events. Installing, activating, deleting or transferring an eSIM can affect whether the plan remains usable or refundable.
5. Roster bundle subscriptions
If roster-bundle subscriptions are offered, checkout will show the recurring price, billing cadence and available pause/cancel terms before you subscribe. A subscription remains subject to sellable destination supply. Pausing or cancelling does not itself promise a refund for a period already billed; the Refund Policy applies. Preview/stub subscription states in a test build do not create billing or service.
6. Roster and check-in features
Roster parsing, flight details, reminders and automatic coverage preparation are convenience tools. You remain responsible for checking the airline's official roster, operational changes, travel requirements and airline check-in. A Kiki “checked in” state is not confirmation of passenger or crew check-in with an airline.
7. Refunds and cancellations
The Refund Policy forms part of these terms. It explains pre-activation cancellations, activation/connectivity failures, troubleshooting, goodwill allowances and pending review. Submitting a request is not confirmation that money or credit has been issued.
7A. Dispute resolution
If a dispute arises, you agree to first contact and attempt in good faith to resolve it informally within 30 days. This is not an arbitration agreement and does not waive your right to bring a claim in the courts identified in Section 12; it is only a first step before either party files in court.
8. Acceptable use
You must not misuse the service, attempt unauthorized access, interfere with networks, resell a plan unless expressly authorized, provide false verification details, circumvent limits, use the service unlawfully, or use automated means to abuse orders, credits or refunds. We may suspend affected features or an account where reasonably necessary to protect users, providers or the service, subject to applicable law.
9. Intellectual property
Kiki's software, text, illustrations, interface and branding are owned by Spicy Kiwi or its licensors. We grant you a limited, personal, non-exclusive, non-transferable licence to use the app on devices you own or control for its intended purpose, subject to App Store usage rules. You keep ownership of information you provide; you allow us to process it only as needed to provide and protect the service, as explained in the Privacy Policy.
10. Service changes and responsibility
We may change or discontinue features, suppliers or plans and will not present unavailable supply as purchasable. To the extent permitted by applicable law, the service is provided as available, and Spicy Kiwi is not responsible for indirect losses caused by device incompatibility, carrier outages, airline schedule changes or events outside its reasonable control. Nothing here excludes mandatory consumer rights or liability that cannot legally be excluded. No unapproved monetary liability cap is stated in this draft.
11. Ending use and deletion
You may stop using the app or reset the local account. In the current build, local reset is not full server/provider deletion. The Privacy Policy explains the prepared deletion endpoint and its current limitations. We may end access for serious misuse or where required by law or a provider, while preserving non-waivable rights and valid refund claims.

13. Changes
We may update these terms as the service changes. Material changes will be identified by an updated effective date and an appropriate app or website notice. Changes will not remove mandatory rights that already apply to a completed purchase.
